Why are Cat traps legal?

I have a neighbor who traps cats, then takes them to the desert and sets them free. Every time we call the ASPCA, or Humane Society, they tell us there is nothing they can do because Cat Traps are Legal. But if the neighbor is taking the cats to the desert and releasing them, isn’t that considered stealing? Or Animal endangerment?
